People get lawsuits dismissed for all kinds of technical reasons, like suing in the wrong county court (tough to tell where a defendant business is located in terms of venue - they move their agents around a lot). Since we have a crazy venue system, for one, it would be massively unfair to place the entire burden for the defendant's costs on a wholly worthy plaintiff because they brought suit in walton instead of gwinnett.
